By accessing and using Softify Cloud ("Service"), you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use our Service.
2. Description of Service
Softify Cloud provides a cloud hosting platform that allows users to deploy, manage, and scale web applications. Our Service includes application hosting, database management, automatic SSL certificates, and related infrastructure services.
3. User Accounts
To use our Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your account information is accurate and up-to-date
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Host illegal content or malware
- Engage in cryptocurrency mining without authorization
- Send spam or unsolicited communications
- Attempt to gain unauthorized access to our systems
- Interfere with other users' use of the Service
5. Payment Terms & Refund Policy
Subscription fees are billed monthly in advance. We reserve the right to change our pricing with 30 days notice. Bandwidth overage charges are billed based on actual usage at the end of each billing cycle.
No Refund Policy
All payments are final and non-refundable. This includes:
- Monthly and annual subscription fees
- Bandwidth overage charges
- Any additional service fees
We do not provide refunds or credits for partial months of service, unused time on your subscription, or downgrade refunds. By subscribing to our Service, you acknowledge and accept this no-refund policy.
6. Service Availability
We strive to maintain 99.9% uptime for our Service. However, we do not guarantee uninterrupted access and may perform scheduled maintenance. We are not liable for any downtime, data loss, or service interruptions.
7. Data and Content
You retain ownership of all data and content you upload to the Service. You grant us a limited license to host and process your content solely for providing the Service. We recommend maintaining your own backups of all data.
8. Cancellation & Termination
Cancellation by You
You may cancel your subscription at any time through your account settings. Upon cancellation:
- Your subscription remains active until the end of your current billing period.
- You will retain full access to the Service until the billing period expires.
- No partial refunds will be provided for the remaining time in your billing cycle.
- Your subscription will not automatically renew after the current period ends.
Data Retention After Cancellation
After your subscription ends:
- You have a 30-day grace period to download your data or reactivate your subscription.
- After 30 days, all your applications, databases, and stored data will be permanently deleted.
- This deletion is irreversible. We strongly recommend backing up your data before cancellation.
Termination by Us
We reserve the right to suspend or terminate your account immediately without notice if you violate these Terms of Service, engage in fraudulent activity, or fail to pay outstanding charges. In such cases, no refund will be provided.
9. Limitation of Liability
To the maximum extent permitted by law, Softify Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
10. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.
